Indian Surrogacy Law Centre

The fine tuning of the smaller details been done and the materials finalised for the launch of IndianSurrogacyLaw.com and the site is to come out by sometime next week or the week after that. I have been getting continuous response from various sectors on what it is about. I finally zero down to blogging to explain what this venture is all about.

“Indian Surrogacy Law Centre” is a law firm set up for the purpose of handling with the problems met by the people involved in the legally uncertain areas of surrogacy. Surrogacy, in simple words, is carrying of a foetus not belonging to her by the surrogate. Consumers of this service can be categorised into three – Intended Parents, Assisted Reproductive Technology Hospitals and finally the surrogates. I find that good numbers of the Intended Parent is coming down to India for engaging a surrogate because it more affordable and legal regulations are negligible.

The legal position of India with regard to surrogacy is still premature and is controlled only Guidelines issued by the Government of India. The THE ASSISTED REPRODUCTIVE TECHNOLOGY (REGULATION) BILL, 2008 is ready and I don’t think it has come to the stage of expressing public opinion as I am not finding it in that website. Still, the normal laws of the nation are in conflict with these procedures and I am finding that the surrogacy agreement entered into by the Intended Parents and the Surrogate do not contain many essential particulars required.

The need for the lawyer in this field in the Indian context is going to be the topic of next post.
